How To Get A Diagnosis Removed From Medical Records

I want to remove this slander from my medical records. The psychiatric drugs and the forever labels themselves made me sick. I am recovered from psychiatry. I included some info on avoiding future labels.

I maintain my right not to have any psychiatric evaluation or diagnosis based upon the Diagnostic and Statistical Manual of Mental Disorders (DSM) as such diagnoses are unreliable. According to Allen Frances, who was chairman of the fourth edition of DSM, "There are no objective tests in psychiatry—no X-ray, laboratory, or exam finding that says definitely that someone does or does not have a mental disorder." ("Psychiatric Fads and Overdiagnosis," Psychology Today, 2 June 2010.) Additionally, the DSM system is not scientific. It's own editors state that "there is no assumption that each category of mental disorder is a completely discrete entity with absolute boundaries dividing it from other mental disorders or from no mental disorder." (DSM-IV, pg. xxii)
Such codes and descriptions should not be entered into my medical records as this unreliable and unscientific information will remain in my records and may wrongly influence any future medical treatment I might receive.

How can I remove this false information from my medical records that makes my insurance cost more ?

You can't. You're stuck living in a world that believes these labels are real "medical diagnoses". Allen Frances played a large part in getting millions more people labeled, so while he says what he said in your quote, now that he's financially secure and mostly retired, he certainly wasn't talking like that in 1994 when he proudly unveiled DSM 4.

Your insurance costing more is a problem. You should bear in mind, the same label can and would be used to deny you a right to enter a plea in a criminal trial, and it can and would also be used to start legal motions to have you foricibly drugged or electroshocked.

I agree with Anonymous, about the labels/psychiatric diagnoses being permanent, unfortunately. It's like that here in Scotland. They pinned one on me and it sits there waiting to pop up at any time, stigmatising and discriminating. I've been challenging it and about the notes written when in/under psychiatric treatment. Which read like the gospel truth and are only someone's opinion, subjective and biased.

I've been told for an incorrect diagnoses there can be another note written to say this. But then psychiatric staff or others can choose to believe the original label and use it as they will. Or that is my experience. It's a tough one. Especially if you have other family members going through the psychiatric system. Then there is mention of 'family history of ….'. Very annoying. I had it recently when my son went in the system and I, as his carer, was treated like a mental patient too. Although recovered now for 10yrs or more. So much for the governments promoting recovery, or hijacking it as some would say.

When you go to a hospital or clinic they have a form you sign for the release of medical information. you don't have to sign it. it is illegal for them to deny you health care for refusing. you can also withdraw permission if you have already signed one of these forms this year. i don't know about the insurance thing. i sounds like something you might have to petition a judge to have removed.
there are limits to how long you can be officially discriminated against by a judge or police officer after a hospitalization, you might want to look it up for your state. the same might go for an insurance company. you can also annoy and waste the time of diagnosing doctors by requesting a written explanation of your diagnosis. i don't know how that would help but if you have many conflicting diagnosis it might help your argument in having some, at least, removed.

I wonder if libel / slander laws could be used as an angle to sue the record keeper to get the diagnosis removed since their is no physical evidence of any disease or illness.

libel- defamation by written or printed words, pictures, or in any form other than by spoken words or gestures.

They say my brain is broken and I am defective yet they have no physical evidence and no medical tests to back it up. That's defamation unless you can PROVE IT !

Chill E. B.'s Song "Prove It" is about one of the biggest scams being conducted in the U.S.: the pharmaceutical industry making billions selling drugs for common conditions of existence which are not diseases at all, but are labeled as such. The biggest victims are kids who are being given narcotics like Ritalin and it's chemical cousin amphetamine just because teachers and parents want to keep them controlled and quite. We are creating a nation of drug addicts just so a few can line their pockets with the profits.

These medical records are looking like criminal records. The Medical Information Bureau is an organization that supplies information to health insurers, life insurers, and other entities which have interest in a combination of your health information and credit information.

Does anyone here use an "alternate" social security number for non-fraudulant purposes? As far as I am concerned, the only people who have a legitimate need to know my SS# are my employer (to file taxes) and my banking institutions (Savings & credit).

The Medical Information Bureau , another private company that poses as a government agency hoping people respect it's illegitimate "authority" and no you can't have my SSN.

What if my health care provider denies my rights to correct and amend my health care file?

Talk to a lawyer. You can get a court order forcing your health care provider to allow you to fix or add to your health care records. You may also collect actual damages for any past refusal to allow you to fix and add to medical records. The law also lets you get attorney's fees and expenses to cover the costs of the lawsuit if you win.

Depending on your situation you may want to "hire a hacker" A simple Google search for "hackers for hire" will reveal a number of sites offering these services.

Is this illegal ??? I don't know but it's your name and your record about YOU, I don't see anything morally wrong with hacking it to get that psychiatric slander and defamation off your electronic medical record.
